General conditions

1. Scope of application

1.1 The general conditions are applicable to all orders for articles placed with DICOMED B.V. By placing an order the customer accepts these general conditions.

1.2 DICOMED B.V. is entitled to refuse to accept an order under specific circumstances. The customer will be informed of this within 10 working days of an order being placed.

1.3 DICOMED B.V. reserves the right to make amendments or additions to these general delivery conditions from time to time.

 

2. Prices

2.1 The prices listed in leaflets, brochures, magazines, websites, etc. are given in euros and include VAT. A contribution to the shipping costs is charged for shipments to addresses within the Netherlands. The actual shipping costs are charged for shipments outside of the Netherlands.

2.2 All offers are free of obligation and DICOMED B.V. expressly reserves the right to alter prices.

 

3. Payment

3.1 The customer can choose between the following payment methods to pay for the goods: payment to our bank account. Other payment options are given on the DICOMED B.V. website.

 

4. Delivery

4.1 DICOMED B.V. is entitled to ship orders in partial deliveries.

4.2. Deliveries will be made via Post NL to the address given by the customer.

4.3 DICOMED B.V. is responsible for the correct delivery of the product. The risk of the products transfers to the customer at the time of delivery.

4.4 The delivery time in the Netherlands is usually within five working days of delivery. However the delivery time varies between four and ten working days.

4.5 An extra delivery time of approximately 5 (five) working days is operated for deliveries to European countries. An extra delivery time of approximately 10 (ten) working days is operated for deliveries to countries outside of Europe.

4.6 The stated delivery times are no more than indicative. The exceeding of any delivery term will not result in a right to compensation or the right to cancel your order or to dissolve the contract unless the delivery time has been exceeded to such an extent that you cannot reasonably be expected to leave the contract in place. In that case you will be entitled to cancel the order or, if necessary, to dissolve the contract.

 

5. Complaints

5.1 The customer is obliged to check whether the article is in keeping with the agreement as soon as it is received.

 

6. Ownership

6.1 The customer shall respect all rights of intellectual property to the article delivered by DICOMED B.V.

6.2 The articles delivered by DICOMED B.V. will remain its property until the customer has met his payment obligations.

 

7. Miscellaneous

7.1 In the event of DICOMED B.V. taking a lenient approach to the provisions of the general sales conditions, that will not affect its right to demand direct and strict compliance with these conditions.

 

8. Force majeure

8.1 Without prejudice to its other rights, in the event of force majeure DICOMED B.V. will have the right to decide at its own discretion whether to suspend the completion of your order or to dissolve the contract without legal intervention by informing you of this in writing and without DICOMED B.V. thus being obliged to pay any compensation for damages unless this would be unacceptable in the given circumstances in accordance to the principles of fairness and equity.

8.2 Force majeure is defined as all non-conformities that cannot be attributed to DICOMED B.V.
